Article 1 – Identity

Article 2 – Applicability
- These terms apply to every offer, agreement, and subscription between Helpers’ Hob and the consumer (“Consumer”).
- By using the platform or entering a Subscription, the Consumer agrees to these terms.
- Deviations are only valid if explicitly agreed in writing.
- If any provision is invalid, the remaining provisions remain fully enforceable.
Article 3 – Nature of the Service (Intermediary Platform)
- Helpers’ Hob operates exclusively as an online intermediary platform facilitating contact between Consumers and independent domestic care providers and handy men who provides home related services (“Providers”).
- Helpers’ Hob does not provide the listed home services itself.
- No employment, agency, partnership, or joint venture relationship exists between:
- Helpers’ Hob and Providers; or
- Helpers’ Hob and the Consumer beyond the Subscription.
- Any/all agreement for services is concluded directly between the Consumer and the Provider.
- Helpers’ Hob is not a party to such agreements and bears no responsibility for their execution and renumeration.
Article 4 – Service Execution and Availability
- Helpers’ Hob will use reasonable commercial efforts to match Consumers with Providers based on preferences.
- Helpers’ Hob does not guarantee:
- availability of Providers;
- suitability, quality, or reliability of Providers;
- continuity of services.
- Replacement efforts are made on a best-efforts basis only.
- The platform may be temporarily unavailable due to maintenance, updates, or technical issues without liability.
Article 5 – Consumer Responsibilities
The Consumer explicitly acknowledges and accepts full responsibility for:
- Screening, interviewing, and verifying Providers (including identity and background checks);
- Compliance with all applicable laws, including:
- employment law,
- tax obligations,
- minimum wage regulations,
- health and safety requirements;
- Drafting and agreeing on terms with Providers;
- Supervision and instructions during work;
- Payment of Providers;
- Any damages or claims arising from the Provider’s work.
Article 6 – Provider Responsibilities
The Provider explicitly acknowledges and accepts full responsibility for:
- Ensuring that agreements made with Consumer are kept;
- Drafting and agreeing on terms with Consumer;
- Compliance with all applicable laws, including:
- tax obligations,
- health and safety requirements;
- Dispute resolution or claims arising from your work.
Article 7 – Pricing, Charges and Changes
- All prices include VAT unless stated otherwise.
- Prices may be adjusted with in dialogue and consent between the Consumer and Provider.
- Changes in the subscription charges will be made with a 30-day advance notification.
- In case of a subscription increase, the Consumer may terminate the Subscription free of charge before the effective date.
- Continued use after the effective date constitutes acceptance and continued subscription.
Article 8 – Payment and Debt Collection
- Subscription fees are charged monthly in advance.
- Customers agree to pay the displayed service fee when requesting a job.
- Charges may include:
- base service fee
- tips (optional)
- Payments are processed automatically through the selected payment method or as otherwise indicated and agreed upon.
- In case of non-payment:
- access may be suspended or terminated;
- statutory interest and extrajudicial collection costs may be charged in accordance with the laws of the land.
- All reasonable costs incurred in collecting outstanding payments shall be borne by the Consumer.
Article 9 – Right of Withdrawal (EU Consumer Law)
- Customers may cancel a request before a worker begins the service.
- If the Subscription is concluded online, the Consumer has a 14-day withdrawal right without giving reasons.
- This period starts on the day the agreement is concluded.
- Late cancellations may be subject to a cancellation fee.
- If the Consumer requests immediate performance during the withdrawal period:
- the Consumer acknowledges that the right of withdrawal may be lost once the service is fully performed;
- proportional costs may be charged for services already delivered.
Article 10 – Liability (Strict Limitation)
- Helpers’ Hob provides a platform connecting customers and workers but does not directly perform the services. Helpers’ Hob is not liable for damages,
- Helpers’ Hob is not liable for:
- acts, omissions, or misconduct of Providers;
- damage to property, financial loss, or personal injury;
- delays, or service issues beyond reasonable control;
- indirect or consequential damages (including loss of income or profits).
- All use of the platform is at the Consumer’s own risk.
- If liability is legally established:
- it is limited to the lower of:
- the amount paid under liability insurance; or
- the total Subscription fees paid in the previous 12 months.
- Liability for gross negligence or intentional misconduct cannot be excluded where prohibited by law.
Article 11 – Indemnification
The Consumer agrees to indemnify and hold harmless Helpers’ Hob against all claims, damages, costs, and liabilities arising from:
- agreements with Providers;
- failure to comply with laws;
- disputes with Providers.
The Provider also agrees to indemnify and hold harmless Helpers’ Hob against all claims, damages, costs, and liabilities arising from:
- agreements with Consumers;
- failure to comply with laws;
- disputes with Consumers.
Article 12 – Duration and Termination
- The Subscription is entered for an indefinite period with a minimum term of one (1) month.
- Termination is possible monthly with notice before the end of the calendar month.
- Helpers’ Hob may suspend or terminate access immediately in case of:
- breast of terms;
- misuse of the platform;
- non-payment
Article 13 – Platform Use and Conduct
- The Consumer shall:
- use the platform lawfully;
- not misuse, copy, or exploit platform data;
- not circumvent the platform to avoid fees where applicable.
- Helpers’ Hob may take measures including suspension or account deletion.
Article 14 – Privacy and Data Protection (GDPR)
- Personal data is processed in accordance with the General Data Protection Regulation (GDPR).
- Data is processed solely for:
- service delivery;
- matching Consumers and Providers;
- legal obligations.
- Consumers have rights including:
- access, correction, deletion;
- restriction and data portability.
- Full details are set out in the Privacy Policy.
Article 15 – Complaints Procedure
- Complaints can be submitted via:
- A response will be provided within 14 days.
- If unresolved, the Consumer may use the EU Online Dispute Resolution platform (ODR).
Article 16 – Applicable Law and Jurisdiction
- All agreements are governed by the court within the land of jurisdiction.
- Disputes will be submitted to the competent court within the land of jurisdiction.
- Mandatory consumer protection rules of the Consumer’s country of residence remain applicable.
Article 17 – Amendments
- Helpers’ Hob may amend these terms.
- Changes will be communicated at least 30 days in advance.
- If the Consumer does not accept changes, they may terminate the Subscription before the effective date.
